A court prosecutor in the Eastern Cape Manzolwandle Xhanti Nkubungu is in hot water after being charged for allegedly raping a university student.

COURT PROSECUTOR IMPLICATED IN RAPE SCANDAL

The 33-year-old Eastern Cape district court prosecutor appeared in the Mthatha Magistrates’ Court today, Tuesday, 27 September on charges of rape.

National Prosecuting Authority (NPA) Regional Spokesperson Luxolo Tyali said the court granted him R3 500 bail, with strict conditions. They postponed the case to 04 November 2022, when he will be joined by his co-accused, Ntuthuzelo Tsotetsi Tsotso (37).

HOW THE UNIVERSITY STUDENT WAS ALLEGEDLY RAPED

According to Tyali, the case emanates from a 28 December 2021 incident during which a 23-year-old university student was allegedly sexually assaulted while sleeping at the prosecutor’s house, after a night out.

“Tsotso was arrested soon after the matter was reported to the police after he was linked to the alleged crime.”

He was released on R3 500 bail. Tyali added that further investigations have since linked Nkubungu, which led to his arrest on Monday, 26 September 2022.

“The NPA views this case, which falls in the realm of gender-based violence, in a very serious light and has commenced internal labour relations processes against the Komani-based prosecutor,” he said.

NPA PROMISES TO PROSECUTE WITHOUT FEAR OR FAVOUR

“The enrollment of this case against one of our own is a clear indication that if there is enough evidence of a commission of crime against anyone, the NPA will prosecute without fear favour or prejudice,” Tyali made it clear.

Meanwhile in Mpumalanga, another prosecutor landed themselves on the wrong side of the law after being found guilty of corruption.

The former District Court Control Prosecutor, Aaron Pule Mohanwe (35), was slapped with 10 years direct imprisonment, for two counts of corruption and defeating the administration of justice last month.
