Convicted murderer and rapist Thabo Bester has filed a fresh application in the Johannesburg High Court, arguing that his classification as a sentenced prisoner is “unconstitutional” and that he deserves more lenient prison conditions.

Bester claims his current treatment violates his constitutional rights and that he should be treated in a “more humane” manner, similar to inmates who are still awaiting trial.

Another legal battle

The application marks yet another legal battle between Bester and the Department of Correctional Services (DCS), which he accuses – along with the National Prosecuting Authority (NPA) – of failing to respect his rights.

“I respectfully submit that the department, together with the National Prosecuting Authority, never respected my rights as an accused person by law,” Thabo Bester stated in his affidavit.

As reported by City Press, Bester is demanding contact visits with his family and legal representatives – privileges typically not extended to inmates serving high-security sentences.

He maintains that his maximum-security classification unfairly limits his access to humane treatment and proper legal interaction.

Ongoing complaints about prison conditions

This is not Thabo Bester’s first attempt to challenge his incarceration terms.

He previously complained about “inhumane conditions” at Kgosi Mampuru II C-Max Prison, including claims of 23-hour solitary confinement and limited exposure to natural light.

In that earlier case, he also alleged that he had been denied sufficient access to legal counsel and family contact, arguing that such restrictions violated his constitutional rights.

One hour of exercise

The Department of Correctional Services has repeatedly dismissed Bester’s allegations, maintaining that he receives treatment appropriate for an inmate at his risk level.

According to the DCS, Bester is entitled to one hour of daily exercise, a shower, and regular legal consultations – the standard protocol for prisoners classified as maximum-security.
